Hot sauce label requirements
A bottle of hot sauce sold at retail needs a statement of identity, net contents in fluid measure, an ingredient list in descending order by weight, an allergen declaration, your name and address, and — unless an exemption applies — a Nutrition Facts panel built on a 1 teaspoon serving. One teaspoon, not one tablespoon. That single number is why most hot sauce panels come back reading almost entirely zeros, and why the layout question on a 5 oz woozy bottle has a real answer.

There's also a requirement that has nothing to do with the label and stops more hot sauce businesses than every labeling rule combined: acidified food registration and process filing under 21 CFR Part 114 and 21 CFR 108.25. Whether it applies depends on how you got the pH down.

Under 21 CFR 101.22 you may declare "spices" collectively, but anything doing double duty as a color — paprika, turmeric, annatto — must be declared as a color additive. Scoville ratings and "world's hottest" claims aren't regulated label elements; they're marketing, held to the general standard that labeling can't be false or misleading.
The serving size is one teaspoon
Serving size isn't your call. It comes from the Reference Amount Customarily Consumed in 21 CFR 101.12, Table 2. Hot sauce sits on the minor condiments row — "horseradish, hot sauces, mustards, Worcestershire sauce" — at 1 teaspoon. Not the tablespoon almost everyone assumes, and not ketchup's row.

FDA states this as a volume, not a weight. There is no universal gram figure for a teaspoon of hot sauce, and any tool that hands you one is guessing. You measure a teaspoon of your sauce and weigh it. A thin Louisiana-style vinegar sauce and a thick fermented mash sauce don't weigh the same. That measured weight — "1 tsp (5g)" or whatever yours is — is what every nutrient gets calculated from.

Why your hot sauce panel is all zeros
At a teaspoon of vinegar, water, and chiles, nearly everything falls below the rounding threshold and declares as 0. Calories 0 or 5. Total fat 0 g. Protein 0 g. Sodium is often the only number with any size to it. That isn't a broken calculator. It's the honest panel.
The regulation anticipates this. Under 21 CFR 101.9(f), where a food contains insignificant amounts of eight or more of the listed nutrients — calories, total fat, saturated fat, trans fat, cholesterol, sodium, total carbohydrate, dietary fiber, total sugars, added sugars, protein, vitamin D, calcium, iron, potassium — you may use the simplified format. It declares total calories, total fat, total carbohydrate, protein, and sodium, plus anything present in more than insignificant amounts, and closes with a "Not a significant source of ___" footnote naming what you left out. Plenty of vinegar-forward hot sauces qualify, and it fits a woozy far better than the full format.
Label space, and why dual columns never apply
A standard woozy has almost no real estate, and 21 CFR 101.9(j)(13) gives relief: packages with less than 12 square inches of available label space may use a tabular or linear format, and packages with 40 square inches or less may use condensed formats with reduced type sizes. A tall narrow strip label is exactly that case.
On servings, divide net contents by one serving and round under 101.9(b)(8)(i). A 5 fl oz woozy is about 30 teaspoons — roughly 3,000% of a 1 tsp RACC. The mandatory dual-column band at 101.9(b)(12)(i) is 200% to 300%, so a retail bottle sails past it. One column, about 30 servings. One claim to be careful with. Sodium is the only nutrient on a typical hot sauce panel with a real number, so "low sodium" is the phrase people reach for. It's a defined claim under 21 CFR 101.13 and 101.61 with a specific threshold, not a descriptive adjective. Using it without meeting the definition is misbranding, and using it at all voids your nutrition labeling exemption.
Is hot sauce an acidified food?
Here's the part almost nobody publishes, and the part where being wrong is genuinely dangerous. We build labels. We do not establish processes, and no label software does.
The three categories
21 CFR 114.3 defines:
- Acid foods — "foods that have a natural pH of 4.6 or below." Vinegar, citrus.
- Low-acid foods — foods other than alcoholic beverages with a finished equilibrium pH above 4.6 and water activity above 0.85. Fresh chiles, garlic, onion, carrot.
- Acidified foods — "low-acid foods to which acid(s) or acid food(s) are added," at water activity above 0.85 and a finished equilibrium pH of 4.6 or below. The regulation's own list of examples names peppers.
So the classic build — fresh chiles, garlic, and onion brought to pH 4.6 or below with distilled vinegar, shelf stable — is squarely an acidified food.
Three things can move a sauce out of that box:
Predominantly acid, with only small amounts of low-acid ingredients. Part 114 excludes acid foods, including condiment sauces, that contain small amounts of low-acid food and whose finished pH doesn't significantly differ from that of the predominant acid. A sauce that is overwhelmingly vinegar with a small proportion of pepper may fall here. "Small" isn't defined in the regulation, which is exactly why this is a judgment call you don't get to make.
Refrigeration. Foods stored, distributed, and retailed under refrigeration are excluded outright, and become time/temperature-controlled products instead.
Fermentation. Part 114 turns on acid or acid food being added. Where the pH drop comes from fermenting the mash rather than adding acid, the product may sit outside the definition. Many fermented sauces are then finished with vinegar, which puts them back in.
Which category your sauce falls into is a determination for a qualified process authority.
What you owe if it is acidified
21 CFR 108.25 sets four obligations, all separate from anything on your label:
- Register the establishment on Form FDA 2541, "not later than 10 days after first so engaging" in acidified food manufacture. This is a distinct filing from FSMA food facility registration under 21 CFR Part 1, Subpart H. Most hot sauce manufacturers owe both.
- File the scheduled process on Form FDA 2541e (acidified method), "not later than 60 days after registration, and before packing any new product," for each product in each container size. A new 10 oz bottle of an existing sauce is a new filing.
- Have a process authority establish that process. 21 CFR 114.83 requires a person with "expert knowledge acquired through appropriate training and experience in the acidification and processing of acidified foods." The regulation never says "process authority," but that's the industry term, and university food science extension programs commonly fill the role. Their letter is what a co-packer, insurer, or retail buyer asks to see.
- Supervise under a trained person. 108.25(f) and 21 CFR 114.10 require operating supervision by someone who has attended "a school approved by the Commissioner" covering pH control and critical factors in acidification. In practice, Better Process Control School, a multi-day university course.
Add 21 CFR 114.80: enough control and testing that finished equilibrium pH never exceeds 4.6, using a potentiometric method — a calibrated pH meter — for finished-product measurement whenever pH is above 4.0. Test strips aren't sufficient there. Records are retained three years under 108.25(g) and 21 CFR 114.100.
One correction to a common assumption: 21 CFR 117.5(d) exempts activities subject to Part 113 — thermally processed low-acid canned foods — from FSMA preventive controls, and only for microbiological hazards. It doesn't mention Part 114. Acidified food processors are generally still subject to preventive controls.
Get the process authority letter first. The label is the cheap part and it comes second.
Where you can make hot sauce at home
Neither of the guides currently ranking for this keyword covers state law, which is strange, because for a first-time maker it's the first question.

Two things to internalize. No state cottage food law requires a Nutrition Facts panel — the allowed states want a home-kitchen disclaimer instead. And a cottage exemption is a state exemption from state permitting; it says nothing about FDA, and shipping across a state line puts you in interstate commerce regardless. Verify your recipe with your state agency before you buy bottles.
California is the conversion moment
If you're making hot sauce in California, none of the above applies, because California bans it from cottage food entirely. Hot sauce, salsa, BBQ sauce, other sauces, pickled products, and canned goods are all off CDPH's Approved Cottage Foods List. Not conditional. Not "with a pH test." Out. The reason is the botulism arithmetic: acidity can't be reliably controlled in an uninspected home kitchen.
So there's no start-at-home path for California hot sauce. Your first legal bottle comes out of a licensed commercial or shared-use kitchen, and the day you rent it you're a food manufacturer under federal law with full labeling under 21 CFR 101.9, unless an exemption below applies. Allergens on a hot sauce label
Nine major allergens under FALCPA: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans, and sesame, added by the FASTER Act effective January 1, 2023. Two legal declaration methods per FDA's food allergies page: parenthetically in the ingredient list, or a "Contains" statement adjacent to it. One or the other, not both.
A vinegar-and-chile sauce often contains none of the nine, which is exactly why makers get caught when they extend the line. Fish sauce and Worcestershire both bring a fish declaration (anchovy). Soy sauce and gochujang usually bring soy and wheat. Chili crisp and chili oil bring sesame. Satay and mole styles bring peanuts or tree nuts. Creamy sauces bring milk. Name fish, shellfish, and tree nuts by species — "anchovy," not "fish." "May contain" is voluntary and never substitutes for a required declaration. When you're exempt, and what kills it
Two exemptions in 21 CFR 101.9 cover most small hot sauce brands:
- 101.9(j)(1) — annual gross sales of $500,000 or less, or annual food sales to consumers of $50,000 or less. No filing, no expiration.
- 101.9(j)(18) — fewer than 100 full-time equivalent employees and fewer than 100,000 units of that product sold in the US in 12 months, with an annual notice. FDA's guidance says in capital letters that "FDA DOES NOT NOTIFY FIRMS WHEN IT IS TIME TO FILE A NOTICE." A micro carve-out — not an importer, under 10 FTE, under 10,000 units — needs no filing.
One detail that catches growing sauce brands: under (j)(18) a "product" is everything sharing a brand name and statement of identity across package sizes. Your 5 oz and 10 oz bottles of the same sauce are one product against one 100,000-unit limit, not two.
Every exemption dies on the same trigger: a nutrient content claim, a health claim, or other nutrition information on the label, in labeling, or in advertising.
