Kombucha label requirements

Kombucha under 0.5% alcohol by volume is a conventional food. FDA rules, ordinary Nutrition Facts panel, ingredient list, allergens, net contents. Kombucha at 0.5% ABV or more is an alcohol beverage regulated by the Alcohol and Tobacco Tax and Trade Bureau — a different agency, a different labeling regime, a federal permit, excise tax, and a mandatory government health warning.

Nothing else in kombucha label requirements matters as much as which side of that line you're on. And the line is not stable, because your product keeps fermenting after you cap it.

The 0.5% threshold, and why it moves

TTB's position is unusually direct, and worth reading twice. From its kombucha guidance: TTB's regulations on alcohol beverages do apply to kombucha that has less than 0.5 percent alcohol by volume when bottled but whose alcohol content increases to 0.5 percent or more at any point afterwards.

That's the whole problem in one sentence. Secondary fermentation in the bottle is not a defect; it's how you get carbonation. Live yeast plus residual sugar plus a sealed container plus a warm truck, a warm shelf, or three weeks in a cooler that isn't quite cold enough, and a 0.4% product becomes a 0.7% product with your FDA-format label still on it. TTB notes on its kombucha labeling page that non-compliance can bring tax assessments, penalties, and potential criminal liability.

Where the classification comes from: 27 CFR 25.11 defines beer as "beer, ale, porter, stout, and other similar fermented beverages... containing one-half of one percent or more of alcohol by volume, brewed or produced from malt, wholly or in part, or from any substitute for malt." Sugar and tea are substitutes for malt. Over the line, your kombucha is beer for tax purposes.

The health warning wording is fixed by 27 CFR 16.21 and must be kept separate from all other label information:

GOVERNMENT WARNING: (1) According to the Surgeon General, women should not
drink alcoholic beverages during pregnancy because of the risk of birth defects.
(2) Consumption of alcoholic beverages impairs your ability to drive a car or
operate machinery, and may cause health problems.

The wrinkle almost nobody explains: beer but not a malt beverage

Here's where hard kombucha stops resembling beer. The Federal Alcohol Administration Act, and the COLA label approval process that goes with it, applies to malt beverages, which 27 CFR part 7 defines as a beverage made by fermenting an infusion of malted barley with hops. Most kombucha has neither.

So a typical kombucha at or above 0.5% is taxed as beer under the Internal Revenue Code but is generally not a malt beverage under the FAA Act. TTB's own labeling page describes the consequence: such products follow FDA labeling rules for the substance of the label, while still complying with IRC marking, branding and labeling requirements under 27 CFR part 25, subpart J, and the ABLA health warning. You end up with a Nutrition Facts-style FDA label and TTB obligations at the same time. TTB says the FAA Act determination is made case by case; the Alcohol Labeling and Formulation Division answers this question at 202-453-2250.

Measuring it properly

TTB's testing methods page says its own lab uses the distillation-specific gravity method, AOAC 935.21, with a densitometer. Producers may use "any method that has been formally validated... or that is otherwise scientifically valid," which must be "accurate, precise, and specific for its intended purpose." A brewing hydrometer reading is not that. Test finished product on a schedule, and test at the end of shelf life — not at bottling, which is the reading that reassures you and proves nothing.

Juice HACCP: the precise answer

This is where the internet gets it wrong in both directions. Two questions, two different answers.

Is plain kombucha subject to 21 CFR Part 120? No. Kombucha is fermented sweetened tea, and FDA's juice HACCP Q&A guidance states that "[c]offee and tea are infusions produced from dried ingredients and have traditionally not been considered to be juices. Thus, they are not covered under the regulation." Tea is not juice. Sugar is not juice. Part 120 does not reach a plain kombucha.

What if you add fruit juice in secondary fermentation? Then read 21 CFR 120.1(a): "Any juice sold as such or used as an ingredient in beverages shall be processed in accordance with the requirements of this part." FDA's Q&A resolves who that lands on. For a beverage made with a juice ingredient: "Because you are not making juice as defined by § 120.1(a), you are not required to produce your juice beverage under a HACCP system, although it is highly recommended. However, the juice ingredient... must have been made under a HACCP program," including the 5-log pathogen reduction at 21 CFR 120.24.

So:

  • Buying pasteurized or HPP-treated juice from a supplier who operates under juice HACCP: you're fine. Keep the supplier documentation.
  • Pressing your own raw juice to flavor your kombucha: you are a juice processor, and part 120 applies to that juice, 5-log requirement included. This is the case brewers walk into without noticing.

The unpasteurized juice warning statement. 21 CFR 101.17(g) requires this on juice that has not been processed to prevent, reduce or eliminate pathogens:

WARNING: This product has not been pasteurized and, therefore, may contain
harmful bacteria that can cause serious illness in children, the elderly, and
persons with weakened immune systems.

Be precise about what it attaches to. Paragraph (g) defines "juice" as the aqueous liquid expressed or extracted from fruits or vegetables, purees, or concentrates of either. A fermented tea beverage that contains some juice is not itself juice, so 101.17(g) does not attach to your finished kombucha on its face. It does attach to untreated juice you sell as juice. The requirement is lifted for juice that has received the 5-log treatment.

The honest bottom line: using 5-log-treated juice resolves the part 120 question and the 101.17(g) question at once, and it's the cheap answer. State retail regulators sometimes read the Food Code's juice provisions more broadly than FDA reads 101.17(g), so ask yours before relying on the narrow reading.

One related detail: under 21 CFR 117.5(b), subparts C and G of the preventive controls rule don't apply to activities subject to part 120, if you're required to comply with part 120 and are in compliance with it. Everything else in part 117, and food facility registration, still applies.

Serving size: the 16 oz bottle is fine, the 32 oz is not

Table 2 of 21 CFR 101.12 puts "carbonated and noncarbonated beverages, wine coolers, water" at a reference amount of 360 mL, with a label statement of "12 fl oz (360 mL)." Kombucha is a beverage; that's your row.

Then the band. 21 CFR 101.9(b)(12)(i) requires a second column when a product packaged and sold individually contains at least 200% and up to and including 300% of the reference amount.

The 16 oz bottle is the workhorse of the category and it is comfortably a single-serving container: 131% of the reference amount, so the entire bottle is one serving and every number on the panel is the whole bottle. You may not split it into 1.3 servings to make the sugar line look better.

The 32 oz is the one that catches brands out. At 263% it sits inside the band, so the panel must carry per-serving and per-bottle columns, each rounded independently rather than one multiplied by the other. Details and the rounding trap: dual column nutrition label requirements.

The 24 oz is worth measuring rather than assuming. FDA's serving size guidance fixes 1 fl oz at 30 mL for label purposes, which makes 24 fl oz exactly 720 mL and exactly 200% — inside the band, since the floor is inclusive. A true fill of 710 mL is 197%, which is not. Measure your actual fill volume before you commit to artwork.

Added sugars when the yeast ate the sugar

Kombucha's other regularly botched line. You add cane sugar, the culture consumes most of it, and the finished product contains far less than you put in. 21 CFR 101.9(c)(6)(iii) and FDA's added sugars guidance give you three routes:

  1. Declare what remains after fermentation. Permitted, but conditioned on records: under 21 CFR 101.9(g)(10)(v)(A) you must keep the scientific data demonstrating the amount of added sugars after fermentation, plus a narrative explaining why that data is sufficient for your type of food.
  2. Declare what you put in before fermentation, with batch records to verify it. Simplest, most conservative, makes your product look sweeter than it is. Most small brewers take this route.
  3. Petition FDA under 21 CFR 10.30 for an alternative means of compliance. Not a realistic small-brand option.

Two hard rules on top. Added sugars can never exceed total sugars, so if your pre-fermentation figure is above the analyzed total sugars in the finished product, declare the analyzed figure. And where the only sugars present are added-type sugars — a kombucha sweetened solely with cane sugar — the sugars remaining after fermentation must be declared as both total and added sugars, which means the two lines carry the same number.

Juice added for flavor changes the math again: sugars from fruit juice concentrate count as added only above what the equivalent volume of 100% single-strength juice would contain. Full method: added sugars label requirements.

Live cultures and probiotic claims

Kombucha marketing runs on gut health, and this is where kombucha brands generate their legal exposure.

Kombucha is a conventional food, not a dietary supplement, and the distinction changes the rules. FDA's label claims overview states that structure/function claims for conventional foods "focus on effects derived from nutritive value," and that FDA "does not require conventional food manufacturers to notify FDA about their structure/function claims, and disclaimers are not required for claims on conventional foods." So the DSHEA disclaimer you've seen on supplement bottles and the 30-day notification do not apply to your kombucha. That freedom is narrower than it sounds, because the nutritive-value limitation is doing real work: a claim resting on live organisms rather than nutrients is on contested ground.

What is not contested: a claim that your kombucha treats, cures, mitigates or prevents a disease makes it an unapproved new drug, and FDA reads your website, your social media and your customer testimonials as labeling. "Supports digestive health" and "cures IBS" are not on a spectrum; they're on opposite sides of a statutory line. The full map of where that line runs is in structure/function claims.

Two smaller points. A CFU count is not a nutrient and does not belong inside the Nutrition Facts panel; put it elsewhere on the label if you want it. And "raw," "unpasteurized" and "live" are descriptive terms, not defined nutrient content claims — they don't void your exemption, but they do have to be true.

Eleven of the fifteen shut the door outright. Which means most kombucha brewers are in a licensed commercial facility from day one — a food manufacturer under federal law, owing full labeling including a Nutrition Facts panel unless the small business exemption applies. Confirm your state with the agency before you build anything; these lists move.

Allergens, including the ones kombucha actually has

Base kombucha — tea, sugar, water, culture — carries no major allergen. Flavored kombucha frequently does, and no cottage food or small business exemption reaches allergen labeling.

FALCPA covers nine: milk, eggs, fish, crustacean shellfish, tree nuts, peanuts, wheat, soybeans, and sesame, added January 1, 2023 under the FASTER Act. Declare parenthetically in the ingredient list or in a "Contains" statement adjacent to it. Tree nuts must be named by species — "almond," not "tree nuts."

The ones that show up in this category: tree nut flavorings and nut milks in creamy or latte-style kombuchas, milk in the same, wheat from barley malt or malted grain adjuncts in hard kombucha or jun-style products, soy from lecithin in a compound flavor base, and sesame in botanical or savory blends. Sub-ingredients count, so a purchased flavor system's spec sheet is part of your allergen record, not the supplier's problem. More: the Contains statement.

The small business exemption, and what voids it

21 CFR 101.9(j)(18): fewer than an average of 100 full-time equivalent employees and fewer than 100,000 units of that product sold in the US in a 12-month period, on a notice filed with FDA annually. FDA states plainly that it does not notify firms when a notice is due. If you are not an importer and have fewer than 10 full-time equivalents, no filing is needed for a product under 10,000 units a year.

It is void the moment a nutrient content claim, a health claim, or other nutrition information appears on the label, in labeling, or in advertising. For kombucha that's a live risk, because "low sugar," "only 2g of sugar," and "keto" are the category's default marketing vocabulary. At what alcohol content does kombucha become regulated by TTB?
0.5% alcohol by volume. At or above that, kombucha is an alcohol beverage: it must be produced on premises qualified by TTB under the Internal Revenue Code, needs formula approval, owes federal excise tax, and must bear the health warning required by the Alcoholic Beverage Labeling Act.
